Former FBI task force leaders charged with lying to Congress on Hunter Biden probes
Two former FBI officials who ran the bureau’s foreign influence unit surrendered Friday on charges they lied to Congress about Hunter Biden investigations, a step prosecutors frame as overdue accountability.
Breitbart News reported that Nikki Cole Floris, 46, and Bradley Benavides, 56, surrendered on arrest warrants after the U.S. Attorney’s Office for the District of Columbia charged them with making false statements to the legislative branch.
The case centers on 2023 testimony before the House Judiciary Committee about the FBI’s since-dissolved Foreign Influence Task Force, or FITF, and its work around former President Joe Biden’s son. Prosecutors say the pair denied FITF involvement that records and witnesses later contradicted.
Floris headed the FITF from mid-2019 until mid-2022. Benavides served as its section chief from mid-2019 through the 2020 election. The unit led FBI efforts to protect the 2020 election from foreign malign influence. In the leadup to that election, the FBI ran several investigations into Hunter Biden in which the FITF took part.
Each defendant was warned that lying to Congress is a crime. Both then testified that the FITF was not involved in the Hunter Biden investigations.
Floris denied any Hunter Biden talks while running the unit
Floris told the committee she took part in no discussions about Hunter Biden while she was at the FITF. Prosecutors say the record shows otherwise.
The U.S. Attorney’s Office stated that evidence shows Floris discussed the FBI’s Hunter Biden investigations routinely for more than a year, both inside the FITF and with others in the bureau.
"Evidence shows that Floris discussed the FBI’s investigations into Hunter Biden routinely for more than a year both within the FITF and with others in the FBI. Contrary to his assertion that he learned of the Hunter Biden laptop from Wikipedia, Benavides regularly discussed the laptop with FBI officials in the leadup to the 2020 election."
That statement came from the office’s announcement of the charges under 18 U.S.C. § 1001(a)(2), the federal law that bars false statements in matters within Congress’s jurisdiction.
An affidavit supporting the criminal complaint cites documentary evidence, contemporaneous communications, and witness accounts that contradict the testimony. The charges form part of an ongoing investigation into the FITF itself.
Benavides claimed he found the laptop on Wikipedia
Benavides testified he only learned the FBI possessed Hunter Biden’s laptop by reading a Wikipedia article in 2023. Prosecutors say he regularly discussed that laptop with FBI officials before the 2020 election.
Just The News reported the arrests of Floris and Benavides over alleged false statements tied to the Hunter Biden laptop investigation, and noted fresh questions about special counsel Jack Smith’s handling of related privileged communications.
The gap between sworn denials and internal discussions sits at the core of the complaint. Congress asked about FITF’s role. The officials said there was none. The affidavit says the paper trail and witnesses say otherwise.
Federal pressure on high-profile Democratic figures has drawn wider notice in recent months, including when FBI agents moved on Eric Swalwell’s D.C. home in a separate misconduct probe.
Patel says senior FBI lies hit the system’s core
FBI Director Kash Patel announced Friday that the two former officials had been taken into custody. He tied the case to a broader cleanup inside the bureau.
"Lying to Congress by senior FBI officials strikes at the heart of our system. No one is above the law. The FBI has already dismantled the corrupt CR-15 squad that engaged in political weaponization targeting their opponents, including President Trump."
Patel also said Floris was on record privately claiming to be “running a shadow government” during the 2020 election in her FITF role. That characterization comes from his public remarks on the arrests.
Separate federal actions have kept scrutiny on Democratic circles as well, from agents questioning Ilhan Omar’s sister after an immigration fraud raid to other enforcement steps in the capital.
Pirro framed the charges in blunt terms after the announcement.
"Lying to Congress by anyone strikes at the heart of our democratic system, but when senior FBI agents lie to Congress believing they are above the law, it’s time to bring the hammer of justice down on them. When senior officials entrusted with safeguarding our nation’s security choose deception over duty, they undermine the very institutions they swore to uphold. Today’s action makes clear that no one is above the law, and we will hold accountable all who obstruct the truth."
The U.S. Attorney’s Office put the same point in plainer legal language: the defendants were charged with false statements in a matter inside Congress’s jurisdiction, and the evidence undercuts what they told lawmakers under warning.
Hunter Biden’s earlier dare sits outside the charging case
In a separate September exchange, Hunter Biden answered a Republican senator’s request that he and Donald Trump Jr. testify about business dealings with a short reply: “Bring it on.” That response is not part of the criminal complaint against Floris and Benavides, but it underscores how long the family business story has stayed in the congressional crosshairs.
Voters watching other Biden-era flashpoints have also seen private outreach and public defense plays, including accounts that Barack Obama called a cable host after Biden criticism yet declined an on-air appearance.
What the charging documents do establish is narrower and harder. Two senior FITF leaders sat before the House Judiciary Committee in 2023. They denied involvement. Prosecutors now say internal talks, documents, and witnesses show FITF did take part in Hunter Biden investigations before the 2020 vote, and that both officials knew far more than they admitted under oath.
Further process continues. The pair surrendered. They were taken into custody. The FITF investigation remains open. Case numbers and a full public docket were not detailed in the initial announcement, and the precise surrender location was not listed.
Other recent enforcement stories have followed a similar arc of warrants, seizures, and political blowback, including when federal agents seized a congresswoman’s passport and devices while building a deportation-related case.
Congress warned these officials that false statements carry criminal risk. They testified anyway. The affidavit now lines their words up against emails, messages, and colleagues. That is how accountability is supposed to work when the people who enforce the rules decide the rules do not apply to them.
