The White House is calling on Congress to override state-level AI laws and replace them with a leaner federal regulatory approach, arguing that a unified national framework is the only way to prevent a regulatory patchwork from strangling innovation and weakening American competitiveness abroad.

The proposal is straightforward: Washington sets the rules, states step back, and AI developers operate under one coherent set of expectations instead of fifty competing ones.

One Market, One Rulebook

The framework opposes state intervention on clear grounds. AI development crosses state lines. It is closely tied to national security and foreign policy. States have been filling the vacuum. With no comprehensive federal framework in place, legislatures across the country have moved ahead in recent years with their own AI-related laws. Some of those efforts are well-intentioned. Many are not particularly well-designed. And collectively, they create exactly the kind of fragmented regulatory environment that rewards lawyers and consultants while punishing the engineers actually building things.

Washington's instinct when confronted with a new technology is to build a new agency, staff it with a few hundred people, give it a vague mandate, and then watch it metastasize into a permanent obstacle. The last thing American AI needs is its own version of the Consumer Financial Protection Bureau: an unaccountable body with broad authority and an ideological agenda baked in from day one.

Instead, the administration recommends relying on existing agencies with subject-matter expertise and encouraging industry-led standards to guide development and deployment. The FDA already regulates medical devices. The FAA already oversees aviation systems. The FTC already polices deceptive business practices. If an AI application touches one of those domains, the relevant agency handles it. No new acronyms required.

Industry-led standards are the other half of the equation. They move faster than government rulemaking, they reflect actual technical realities, and they can be updated without a two-year notice-and-comment process. None of this means a free-for-all. It means the people who understand the technology have a seat at the table instead of being handed a compliance manual written by staffers who learned about large language models from a briefing packet.

Sandboxes and Developer Liability

The proposal also calls for the creation of regulatory "sandboxes," controlled environments where companies can test AI applications with fewer regulatory constraints. This is a concept borrowed from fintech regulation, where it has shown real promise. Let companies experiment, gather data, and demonstrate safety before the full weight of compliance kicks in. It rewards innovation without abandoning oversight.

There's also a critical liability principle embedded in the framework: states should not penalize AI developers for how third parties use their systems or restrict lawful uses of AI technology. This is common sense dressed up as policy. If someone uses a kitchen knife to commit a crime, we don't sue the cutlery manufacturer. The same logic should apply to AI tools. Holding developers responsible for every downstream use of their technology doesn't protect consumers. It just ensures that the most cautious, least innovative companies are the only ones left standing.

That principle alone, if codified, would defuse dozens of state-level proposals currently designed to create expansive liability regimes that have more to do with plaintiff attorneys' business models than public safety.

The Real Competition Isn't Domestic

The unstated backdrop to all of this is China. Every month spent navigating a maze of contradictory state regulations is a month that Chinese AI firms, backed by a government that views technological dominance as a strategic imperative, operate without those constraints. The race for AI supremacy is not a metaphor. It has military, economic, and intelligence dimensions that make regulatory clarity a national security question, not merely a business one.

The administration's framework recognizes this. Officials frame the approach as one designed to "remove barriers to innovation." That language is deliberate. The barriers are real, they are multiplying, and they are self-inflicted.

American AI companies are the best in the world right now. The question is whether Washington will let them stay that way, or whether fifty state legislatures will regulate that advantage into the ground one bill at a time.

What Congress Does Next

The proposal now sits with a Congress that has spent years talking about AI regulation without producing much of substance. That inaction is what created the state-level free-for-all in the first place. Legislators who complain about a patchwork of state laws should remember that they left the quilt unfinished.

The framework gives Congress a clear template: preempt the patchwork, resist the urge to build new bureaucracies, let existing regulators handle their lanes, and create space for American companies to innovate without hiring a compliance army. It is a genuinely conservative approach to a genuinely complex problem.

Whether Congress can execute on it is another question entirely. But the blueprint is sound. Light-touch, federally unified, innovation-friendly, and grounded in the reality that the biggest threat to American AI isn't under-regulation. It's regulation by a thousand cuts.
