Former Prosecutor Pushes for Immediate Trump Imprisonment Before Election

On Thursday, Glenn Kirschner, a former federal prosecutor, has urged Judge Juan Merchan to sentence former President Donald Trump to prison without delay following his sentencing on Sept. 18.

Trump’s attorneys have requested that the sentencing be postponed until after the November election to allow time for an appeal against the jury’s guilty verdict, but Kirschner says immediate incarceration should occur, as the Daily Caller reports.

Kirschner’s call for prompt sentencing to jail time came a day after Trump’s attorneys submitted a request to postpone the sentencing until after the upcoming November election. Kirschner stressed what he feels is the importance of not delaying the sentencing, urging Judge Merchan to proceed as scheduled on Sept. 18.

The former prosecutor argued that Trump’s actions were severe enough to warrant prison time, not probation. His appeal emphasized that to prevent what he sees as future attempts at undermining democracy, it is crucial to penalize those who have attempted it in the past.

He expressed his concern that Judge Merchan might put the sentence on hold to allow Trump the opportunity to appeal. Kirschner stated, “I hope Judge Merchan… proceeds to sentencing on September 18th, sentences him to prison, which he so richly deserves.”

Trump’s legal team argued for postponement, contending the time is needed for an appeal, particularly if Merchan denies defense attorneys' motion to overturn the jury’s guilty verdict. Trump was convicted by a Manhattan jury in May on 34 counts of falsifying business documents concerning payments made to Michael Cohen for a nondisclosure agreement with Stormy Daniels.

Initially, Trump’s sentencing was slated for July 11 but was delayed following a U.S. Supreme Court ruling on presidential immunity. The defense claims the postponement is critical, especially with the likelihood of an appeal.

Judge To Rule on Motion Before Sentencing

Merchan is scheduled to rule on Trump’s motion to void the jury’s guilty verdict on Sept. 16. Any decision to delay sentencing relies heavily on the outcome of this pending ruling.

Kirschner remains hopeful that the judge will not stay the imposition of a sentence should Trump appeal.

He elaborated on his standpoint, emphasizing that Trump’s re-election could disrupt the broader legal proceedings, stating, “As long as he’s not elected president, he will not have the opportunity to kill his cases, his federal cases… his state cases.”

Kirschner, who is also an MSNBC legal analyst and has a significant following on YouTube, used his platform to voice his concerns. He teaches criminal law at George Washington University and says his insights are rooted in his experience as a former assistant U.S. attorney.

He underscored the significance of enforcing justice to prevent what he says could be Trump's potentially authoritarian ambitions, saying, “You’ve got to punish today’s aspiring dictator for the crimes he committed to try to steal the presidency.”

Merchan’s Previous Decisions on Recusal

Earlier requests for Merchan to recuse himself from the case were denied, with the latest denial linked to arguments about his daughter’s professional connections to Democratic Party clients.

However, those assertions have not altered the judge’s standing on overseeing the case. Kirschner pointed out the risks of Trump leveraging potential future presidential power to influence his pending federal and state cases. He remarked, “He won’t have that opportunity to get rid of them. But he will, if God forbid, he ever retakes the reins of presidential power.”
