Brazilian Court Warns X of Immediate Ban Over Censorship Dispute

The Brazilian Supreme Federal Tribunal (STF) Minister Alexandre de Moraes has issued an ultimatum to social media platform X, formerly known as Twitter, demanding the appointment of a legal representative in Brazil within 24 hours or face suspension.

The stern directive comes amid a growing series of legal conflicts between de Moraes and X’s owner, Elon Musk, over the platform's compliance with Brazilian laws regarding content regulation, as Breitbart reports.

On Wednesday, de Moraes took to X to issue a subpoena to the platform and Musk, making it the first instance where the Brazilian Supreme Court has leveraged social media to deliver a legal order. The order requires X to designate a qualified legal representative in Brazil, with the threat of suspension looming if the platform fails to comply within the stipulated timeframe.

X’s office in Brazil was closed last week, adding another layer of complexity to this confrontation. According to X’s global government affairs team, the decision to shut down the office was precipitated by threats from de Moraes to arrest X’s Brazilian legal team for failing to adhere to his censorship orders.

The platform has maintained that its Brazilian staff had no authority over the blocking of content, arguing that de Moraes' demands were not only unreasonable but also beyond employees' control.

Elon Musk and X Respond to Legal Actions

In response to de Moraes' actions, Musk used X to post a photoshopped image of de Moraes as a Star Wars villain, openly criticizing the judge and accusing him of violating the very laws he is tasked with upholding.

This provocative move by Musk underscores the heightened tensions between the tech billionaire and the Brazilian judiciary, particularly as it relates to issues of freedom of speech and legal compliance on digital platforms.

De Moraes has been an active figure in Brazil's efforts to combat what he terms "fake news" and "anti-democratic digital militias."

Over the past several years, he has spearheaded multiple censorship actions, targeting supporters of former President Jair Bolsonaro, journalists, and other figures he deems problematic. His orders have extended to various platforms, including X, YouTube, Facebook, and Instagram, demanding restrictions on certain accounts to curb the spread of disinformation.

In April, de Moraes initiated an investigation into Musk following the latter's declaration to defy a court order requiring the censorship of specific accounts on X. The court order had stipulated a fine of $19,700 per day for each account that remained non-compliant. Musk's defiant stance led to calls for de Moraes' impeachment and accusations that the judge had manipulated the 2022 Brazilian presidential election.

Broader Implications of De Moraes' Censorship Actions

During the 2022 election campaign, de Moraes ordered Bolsonaro's campaign not to use certain language against then-candidate Luiz Inácio Lula da Silva, describing him as a "thief" or "criminal." He also imposed a fine of $4.27 million on Bolsonaro’s party for what he described as "bad faith litigation." These moves have drawn both support and criticism, reflecting the polarized political landscape in Brazil.

Despite complying with de Moraes' censorship orders earlier in the year, X continues to face new legal challenges. In August, the platform disclosed a court order dated July 23 that demanded the censorship of a new set of accounts within a five-day window. A subsequent order on August 14 called for further restrictions on various Brazilian users, including political and religious figures.

X’s global government affairs team expressed dismay over the forced closure of their operations in Brazil, attributing the responsibility solely to de Moraes.

"We are deeply saddened that we have been forced to make this decision," they stated. "The responsibility lies solely with Alexandre de Moraes." They emphasized their belief that the Brazilian public has the right to be informed about the orders imposed on the platform, highlighting the lack of transparency in the judicial process.

Controversy Surrounding Legal Justifications

A report by Folha de Sao Paulo suggested that de Moraes had utilized unofficial reports from Brazil's Electoral Court to justify his rulings against Bolsonaro supporters, which included measures such as passport cancellations and social media account blocks.

De Moraes, however, denied any wrongdoing, asserting that all investigations related to "fake news" and "digital militias" were official and conducted with full transparency and participation from the Attorney General’s Office.

The ongoing legal battle between de Moraes and Musk represents a broader clash over digital governance and the limits of free speech in the digital age.
