Bucks County Leaders Challenge PA Court, Count Unsigned Ballots

 November 16, 2024

In a controversial move, Bucks County Commissioners have chosen to count provisional ballots lacking signatures, openly defying a recent legal mandate from the Pennsylvania Supreme Court.

Bucks County's defiance comes as Democrats, including Senator Bob Casey, challenge the provisional election results favoring Senator-elect Dave McCormick, Breitbart reported. The core of the issue began when Commissioners Robert J. Harvie Jr. and Diane Ellis-Marseglia led the decision to count unsigned ballots, specifically from sections known as "block two" and "block four." This decision directly contravenes a ruling from the Pennsylvania Supreme Court mandating signatures on provisional ballots.

Legal Recommendations Ignored in Ballot Counting Decision

Deputy County Solicitor Daniel Grieser advised the commissioners against counting these ballots. However, his guidance was overlooked as the commissioners proceeded with their plan. This defiance has sparked significant controversy within the community and beyond.

Republican Commissioner Gene DiGirolamo opposed the move, presenting a motion to discard all unsigned ballots, which ultimately failed. The political tension in Bucks County escalated as a result of this decision.

During a heated discussion, Vice Chair Ellis-Marseglia dismissed the legal precedent, indicating a desire to challenge the existing law and to force the courts to reconsider their stance on ballot signatures.

Bucks County's Stand May Lead to Broader Legal Battles

"I think we all know that precedent by a court doesn’t matter anymore in this country, and people violate laws anytime they want. So for me, if I violate this law, it’s because I want a court to pay attention to it," Ellis-Marseglia stated, emphasizing her commitment to counting every vote, even at the risk of legal consequences.

This statement has further complicated the legal narrative surrounding Pennsylvania's current election cycle, where disputes over election procedures and results continue to escalate.

Walter Zimolong, representing the Republican stance, emphasized the Supreme Court's directive requiring each ballot to be signed in two specific places for validity. His reminders highlight the legal obligations that the commissioners decided to ignore.

Electoral Tensions Escalate as Republicans Rally for Compliance

In response to the commissioners' actions, the Bucks County Republican Party, along with the Republican National Committee and the Pennsylvania GOP, declared their intention to pursue all available legal avenues to rectify what they consider a blatant disregard for the law.

Meanwhile, the election results hang in balance with a pending recount. McCormick's current lead stands at 24,154 votes, but with the controversy over these ballots, the final outcome remains uncertain.

As the situation develops, legal experts and citizens alike are watching closely, anticipating the potential impacts this defiance could have on both local and national election integrity.

Community and Legal Experts Watch Closely

The community has reacted with mixed opinions; some support the commissioners' stand as a fight for voter rights, while others view it as a dangerous precedent that undermines electoral laws.

Legal experts suggest that this could significantly reshape election conduct, particularly by affecting ballot validity and voter verification processes.

As the legal battles unfold, the outcome of this defiance by Bucks County officials could have far-reaching consequences for election law enforcement across the United States.
