Rep. Chip Roy Demands Biden DOJ Documents on Prosecution of TX Doctor

 June 28, 2024

A prominent lawmaker is demanding documents from Attorney General Merrick Garland related to the prosecution of Dr. Eithan Haim, who faces charges for exposing ongoing child sex change procedures at Texas Children's Hospital.

Rep. Chip Roy (R-TX) argues that the DOJ is targeting Dr. Haim for ideological reasons rather than enforcing the law impartially, as the Post Millennial reports.

On Thursday, Roy sent a letter to Attorney General Merrick Garland. The letter demands that the Department of Justice (DOJ) provide internal documents regarding the prosecution of Dr. Eithan Haim.

Dr. Haim, a physician, is currently facing severe legal penalties, including up to 10 years in prison, for his actions in exposing child sex change procedures at Texas Children's Hospital.

Dr. Haim Faces Serious Charges

Dr. Haim has been accused by the DOJ of obtaining protected health information without authorization for patients not under his care. The DOJ's charges against him include potential fines up to $250,000. This controversy has its roots in a 2022 opinion by Texas Attorney General Ken Paxton, which classified child sex change procedures as child abuse.

Following Paxton's opinion, Texas Children's Hospital announced it would cease performing such procedures on minors. However, in 2023, Dr. Haim revealed that the hospital continued to conduct these interventions, despite the previous announcement.

Legislative and Legal Repercussions

The revelations by Dr. Haim prompted significant legislative action in Texas. The state enacted bipartisan legislation banning transgender medical interventions for minors. This legislative move came after Dr. Haim's disclosures brought the issue into the public eye.

Amidst these developments, the Subcommittee on the Constitution and Limited Government initiated an investigation into the DOJ’s actions against Dr. Haim. Roy, in his letter, criticized the DOJ for allegedly using the law to target ideological opponents. The congressman asserted that Dr. Haim did not violate HIPAA regulations, as he did not disclose unredacted patient charts or documents.

Accusations of Ideological Targeting

Roy's letter includes strong allegations against the DOJ, claiming that the prosecution of Dr. Haim is part of a broader pattern of using legal tools to suppress dissent.

“While Dr. Haim’s bravery to come forward led Texas to enact bipartisan legislation banning ‘transgender medical interventions’ for minors, the Department of Justice chose to prosecute Dr. Haim,” Roy wrote. He further stated, “This prosecution is just the latest example of how the Biden-Garland Justice Department is using the law to target ideological adversaries instead of equally enforcing the law.”

Dr. Haim's Defense and Public Response

Dr. Haim has not remained silent in the face of these charges. He has actively communicated his stance and experiences through social media. In a recent post on X (formerly Twitter), Dr. Haim expressed his resolve against what he described as federal intimidation tactics.

"They wanted to intimidate me into silence using every technique the federal leviathan had at their disposal. But they failed," Haim wrote. He encouraged others to resist corruption and fight back, stating, "The only way to lose is to submit to corruption. It's time to fight back harder than ever!"

Financial Support for Legal Defense

In light of his legal battle, Dr. Haim has garnered substantial public support. He has launched a GiveSendGo campaign to fund his legal defense.

As of now, the campaign has raised nearly $870,000, with a goal of one million dollars.

This financial backing underscores the public's vested interest in Dr. Haim's case and the broader implications it has for ideological freedom and the enforcement of laws.

Conclusion

In summary, Rep. Chip Roy is demanding that the DOJ release internal documents related to the prosecution of Dr. Eithan Haim. Haim faces significant legal challenges for exposing ongoing child sex change procedures at Texas Children's Hospital, a move he argues was in the public's interest.

The case has sparked legislative changes in Texas and raised serious questions about the impartiality of the DOJ's enforcement actions. As the investigation by the Subcommittee on the Constitution and Limited Government continues, Dr. Haim remains a polarizing figure, with significant public support rallying behind him in his legal fight.

Overall, the controversy surrounding Dr. Haim and the DOJ highlights the complex intersection of law, medical ethics, and ideological battles in contemporary America.
