Federal judge orders trial for Rep. LaMonica McIver over ICE facility incident

On Thursday, U.S. District Judge Jamel Semper decided that Rep. LaMonica McIver, a Democrat from New Jersey, must face trial for allegedly assaulting federal law enforcement officers during a chaotic incident at the Delaney Hall ICE detention facility in Newark, as Breitbart reports.

Let’s rewind to the beginning of this saga, back to May 9, when Rep. McIver, alongside fellow Democrat Reps. Bonnie Watson Coleman and Robert Menendez, plus Newark Mayor Ras Baraka, showed up at Delaney Hall claiming to conduct what they called "federal oversight."

Judge Rejects Immunity Claim in McIver Case

Things quickly spiraled out of control as the group allegedly forced their way into the facility, leading to accusations of trespassing.

Mayor Baraka was initially arrested on a criminal trespass charge, but the Department of Homeland Security later dropped the case against him, leaving McIver in the hot seat.

After a thorough investigation by Homeland Security Investigations, complete with video footage from the scene, McIver was officially indicted on three serious counts: assaulting, resisting, and impeding federal officials.

Charges Carry Heavy Penalties for Congresswoman

Acting U.S. Attorney for the District of New Jersey, Alina Habba, clarified that two of these charges could land McIver up to eight years in prison, while the third carries a maximum of one year behind bars.

Department of Homeland Security Secretary Kristi Noem didn’t mince words when announcing the charges alongside Habba, emphasizing that even elected officials aren’t untouchable when it comes to breaking the law.

“No one is above the law,” Noem declared, driving home a point that resonates with those tired of seeing elites dodge accountability.

Noem Slams McIver’s Actions at Delaney Hall

Secretary Noem also noted that her office had previously extended invitations to officials wanting to tour the facility, rendering the Democrats’ dramatic stunt at Delaney Hall entirely unnecessary.

“If any person, regardless of political party, influence or status, assaults a law enforcement officer as we witnessed Congresswoman McIver do, you will be prosecuted to the fullest extent of the law,” Noem added, a statement that cuts through the fog of partisan excuses.

McIver’s Defense Falls Flat in Court

When McIver tried to get two of the three charges tossed out, she argued they were politically motivated and claimed her status as a congresswoman should shield her from prosecution.

Judge Semper wasn’t buying it, flat-out rejecting the notion that holding office grants a free pass to clash with law enforcement.
