In 2015, he resigned following a federal indictment related to fraudulent activities at a health food restaurant he co-owned.

After pleading guilty to one count of tax evasion, Grimm served seven months in prison and was released in 2016. His attempt at a political comeback in 2018 was unsuccessful, losing to incumbent Rep. Dan Donovan in a Republican primary.

The 11th House District, which Grimm once represented, now falls under the leadership of Republican Rep. Nicole Malliotakis, covering Staten Island and parts of Brooklyn.
