Homan says Ocasio-Cortez facing inquiry over immigration status of former employee

 July 2, 2025

Controversy has erupted as claims emerge that Rep. Alexandria Ocasio-Cortez (D-NY) is under scrutiny for allegedly employing an illegal immigrant and aiding others in sidestepping immigration enforcement.

Tom Homan, the Trump administration's border czar, reported that ICE is currently examining the matter but refrained from additional commentary due to the existence of active investigations, as the Washington Times reports.

The allegations surfaced amid Ms. Ocasio-Cortez's prominent advocacy for immigrant rights. She has hosted educational initiatives, such as the "Know Your Rights" webinar earlier this year, aimed at informing her constituents and others about their rights regarding immigration enforcement.

Diego de la Vega's move raises questions

The investigation follows a move by Diego de la Vega, former deputy communications director for Ms. Ocasio-Cortez, who relocated to Colombia in March. He spent most of his life undocumented in the United States, arriving when he was seven years old.

Expressing mixed emotions about his transition, de la Vega described moving to Colombia as a "bittersweet" yet fulfilling experience, allowing him to finally live beyond the reach of the legal shadows that defined much of his existence in the U.S.

Before working with Ms. Ocasio-Cortez in 2022, de la Vega had an active political role, serving as a congressional fellow under former Rep. Carolyn Maloney. His departure has, however, ignited further discussion surrounding employment practices within Congress.

Homan calls for action against AOC

Homan, who has been vocal about the perceived inadequacies in enforcing immigration laws, argued that such webinars may encourage illegal activities.

"As far as you know her educating people on how to evade ICE arrests, she’s really educating them on how to be prosecuted," Homan said, advocating for a Justice Department action.

Ms. Ocasio-Cortez has publicly responded to the pressures and assertions raised by Homan, particularly emphasizing her rights under the U.S. constitution. She reached out to Attorney General Pam Bondi inquiring if the Department of Justice is indeed investigating her actions prompted by Homan's request.

In her communications, Ms. Ocasio-Cortez questioned whether political influences have unjustly spurred these legal inquiries and defended her informational campaigns designed to assist constituents.

Ocasio-Cortez stands firm

Despite the intensifying scrutiny, Ms. Ocasio-Cortez remains steadfast in her positions. During a community gathering in Queens in May, she boldly addressed the mounting political heat, expressing a firm stance against what she perceives as political intimidation.

Her communications indicate that she regards the threats of legal action as a challenge to free expression. Remaining defiant, she countered the tumultuous situation with the statement, "Come for me."

For de la Vega, the impact of this scrutiny has added another layer of complexity to an already intricate personal journey. While he expresses relief in escaping an "illegalized" status, he acknowledges that returning to the United States remains an uncertain prospect for the foreseeable future.

Repercussions and broader implications awaiated

The situation surrounding Ms. Ocasio-Cortez serves as a stark reminder of the ongoing national conversation about immigration policy, enforcement, and the rights of undocumented individuals residing in the U.S.

Whether the investigation will lead to any formal proceedings against Ms. Ocasio-Cortez remains uncertain, as ICE continues to evaluate the claims. Homan maintains that employing undocumented individuals within Congress is not achievable, highlighting the complexities of vetting processes.

The case also underscores the potentially contentious interaction between federal agencies and elected officials, especially when legal interpretations intersect with politically charged landscapes.

In the meantime, the focus remains on the broader implications of the investigation on immigration practices within political spheres. Public sentiment continues to diverge, reflecting evolving perspectives on accountability and advocacy in the realm of U.S. politics.

As further developments unfold, this story is expected to remain at the forefront of both political discourse and public interest given its critical nature and widespread resonance.
