Hunter Biden's legal team has launched a vigorous defense as he faces significant legal challenges this month.

Amid fears of political persecution, Hunter Biden's legal representation seeks to mitigate impending penalties at sentencing, while his father, President Joe Biden, maintains his decision not to issue a pardon, as the Washington Post reports.

Hunter Biden's attorneys recently released a detailed 52-page defense entitled "The Political Prosecutions of Hunter Biden." This document aims to counter the charges as Hunter Biden prepares for his upcoming sentencing for gun and tax offenses in Delaware and California.

In June, a federal jury found Hunter Biden guilty of making false statements on a gun purchase form and illegal possession of a firearm. His sentencing for these gun-related charges is scheduled for Dec. 12.

Following this, Hunter Biden entered a guilty plea to nine federal tax charges in September, which allowed him to avoid a jury trial for these offenses. His sentencing on the tax charges is set for Dec. 16.

Legal Team Criticizes Motivations Behind Prosecution

The defense argues that the prosecution of Hunter Biden is highly politically motivated, particularly with the imminent return of Donald Trump to the presidency. They claim that the foundation of these investigations is flawed and influenced by Hunter Biden's status as the son of the president.

Special counsel David Weiss, who was appointed under the Trump administration and stayed on during Biden's presidency, led the prosecutions. The defense document sharply criticizes the handling of the case, suggesting that the legal actions taken were unduly harsh and influenced by political factors.

According to the document, if Hunter Biden were not the president's son, he likely would not have faced prosecution.

White House Maintains Stance on Non-Intervention

Despite the tumultuous legal battles, President Joe Biden has been clear about his stance on not pardoning his son. This position was reiterated by White House Press Secretary Karine Jean-Pierre on Nov. 7, emphasizing that the president would neither pardon nor commute Hunter's sentence.

Abbe Lowell, Hunter Biden’s attorney, expressed concerns that the prosecution reflects a broader political effort to target President Biden indirectly. Lowell described the case as "a wild and terrifying story" and a "stark warning of what is to come."

The legal team also included a timeline of events since 2017, which they claim illustrates a pattern of unfair targeting by federal prosecutors against Hunter Biden.

Challenges in the Legal Landscape for Hunter Biden

Hunter Biden's legal predicament could lead to severe sentences, further complicated by his previous guilty verdict which now categorizes him as a felon. His team argues that similar offenses typically result in less severe consequences, which underscores their claims of unequal treatment under the law.

Quotes from the defense report highlight the perceived threat against Hunter Biden, with one stating, "With the election now decided, the threat against Hunter is real." Another quote from the report asserts, "There is no disputing that Trump has said his enemies list includes Hunter."

Weiss offered a contrary position to these views in court, stating, "No one in this country is above the law. Everyone must be accountable for their actions, even this defendant."

The defense argues that the Justice Department faced significant political pressure during the prosecutions, suggesting a system corrupted by political influences.

"A system that is supposed to protect against abuses failed to do so and was corrupted by political leaders in this country," states the defense report.

Defense attorneys for the first son also emphasize the personal and familial impact of the prosecutions on Hunter Biden, describing the emotional and psychological toll it has taken.
