Hunter Biden’s lawyers threaten DOJ with ‘constitutional crisis’ involving President Biden

Hunter Biden's legal defense team, headed by attorney Chris Clark, has issued a warning to the U.S. attorney investigating his client's case.

The defense indicated that if Hunter were to be charged, they would call President Joe Biden to the witness stand, potentially creating a constitutional crisis by pitting the commander in chief against his own Department of Justice,  as Daily Wire reported.

Hunter Biden's Charge and Defense's Response

This warning followed a revelation in the media that federal prosecutors were reportedly confident they had ample information to charge Hunter Biden with illegal firearm purchases.

In an extensive letter to prosecutors, Clark stated, "President Biden now unquestionably would be a fact witness for the defense in any criminal trial," Politico reported.

He further stressed that the case did not justify "the spectacle of a sitting president testifying at a criminal trial nor the potential for a resulting Constitutional crisis."

Changes in the Investigation and Plea Deal

The New York Times released a report last Saturday, shedding light on the evolving stance of Special Counsel David Weiss during the investigation into Hunter Biden.

The report stated that Weiss altered his stance in the inquiry regarding the plea deal his office had been willing to extend to Hunter Biden.

According to the report, Weiss was initially open to not pursuing the case against Hunter Biden before his appointment as special counsel.

He was inclined "to forgo any prosecution of" Hunter Biden and was nearing a decision "to agreeing to end the investigation without requiring a guilty plea on any charges."

However, this position shifted after two IRS agents alleged that their efforts to further the Biden investigation had been thwarted due to pressure from higher-ups at the Department of Justice.

These whistleblowers' accounts have caused Weiss to insist that Hunter Biden plead guilty to two misdemeanor tax crimes and enter a deferred prosecution agreement regarding a gun charge.

Motivation Behind Weiss Seeking Special Counsel

The report also delved into the various factors that motivated Weiss to request U.S. Attorney General Merrick Garland to appoint him as special counsel earlier this month.

Reasons for Weiss's decision included seeking greater authority to investigate and prosecute and gaining increased leverage over Hunter Biden in future negotiations.

Additionally, he is now mandated to produce a report at the end of the investigation, allowing him to respond to the strong criticism he has received from Republicans.

Republican Response to Wesis Appointment

Garland's decision to appoint Weiss as special counsel has been criticized by numerous prominent Republicans, who allege that he is attempting to assist Hunter Biden.

Florida Gov. Ron DeSantis, and 2024 GOP presidential candidate, stated, "Just seems to me that they're going to find a way to give him some type of soft glove treatment. And I don't understand why you would appoint this guy to be the special counsel. But we've come to expect that."

He added, "I think that there was a lot that [Hunter Biden has] done, particularly with the corruption, that really should be pursued."
