Trump says Jack Smith concealed evidence and colluded with Biden administration

Donald Trump's legal team has accused Special Counsel Jack Smith of concealing crucial evidence in the ongoing Florida case involving the former president's handling of classified documents. 

The accusation centers around the allegation that Smith's office failed to disclose its interactions with the Biden administration fully, as Newsmax reported.

According to a report by the Daily Caller, this claim was detailed in a 68-page legal filing on Wednesday, citing information obtained through a Freedom of Information Act (FOIA) request.

Allegations of Political Motives

Trump's attorneys argue that the documents, which were heavily redacted, suggest a collaboration between "politically motivated operatives in the Biden administration and the National Archives and Records Administration" (NARA).

This collaboration is alleged to have influenced the investigation into the classified documents since 2021. 

The lawyers contend that these documents, which they argue should have been presented in an unredacted format at the beginning of the case, indicate a potential bias and political animus against the former president.

Accusations of Partisan Interference

The legal team of the former president has strongly criticized the Special Counsel's Office for what they describe as a failure to adhere to standard discovery obligations and Department of Justice policies. 

They assert that these actions are part of an attempt by the Biden administration to "weaponize the criminal justice system" against Trump, whom they see as a leading contender in the 2024 presidential election. 

Trump's lawyers state: "The patent absurdity of the Office's efforts is illustrated by the fact that, while working toward a historic landslide victory in the Iowa caucuses yesterday, President Trump was also preparing to bring to Your Honor's attention today the record of misrepresentations and discovery violations that have marred this case from the outset and illustrate that the Office has disregarded fundamental fairness and its legal obligations in favor of partisan election interference." 

They also highlight Trump's resounding victory in the Iowa caucuses this week as evidence that the charges against him in the case constitute "partisan election interference," as NBC News reported.

Further Claims of Involvement by Biden Administration and NARA

According to the details in the FOIA request, evidence suggests that NARA and various components of the Biden Administration, such as the White House Counsel's Office, along with senior officials at the Department of Justice and the FBI, were closely involved in the investigation. 

This involvement, as alleged in the filing, points to a broader pattern of cooperation between these entities in the case against the former president.

Additionally, the legal document mentioned that at the trial, Trump's team intends to challenge the claims made by the Special Counsel's Office regarding the security of Mar-a-Lago and the potential risk of compromising materials stored at the premises.

Charges and Superseding Indictment

Former President Trump has faced a slew of legal accusations, including dozens of felony counts related to over 100 classified documents found at his Mar-a-Lago resort in Florida.

The charges encompass 31 counts of willful retention of national defense information and single counts of false statements, conspiracy to obstruct justice, withholding a document or record, corruptly concealing a document, and concealing a document in a federal investigation.

Additionally, there are charges related to involvement in a scheme to delete security video at Mar-a-Lago.

Trump's legal woes continued with additional charges in a superseding indictment filed in July 2023.
