Judge Hints at Imminent Decision on Trump's Recusal Motion Ruling Amid Familial Bias Concerns

In a recent development in Donald Trump's ongoing legal battles, a judge in New York has teased a crucial ruling related to Trump's call for the presiding jurist's recusal, which cited familial connections to Vice President Kamala Harris.

In discussing the impending recusal decision, the judge also postponed a decision on Trump's motion to overturn his felony convictions, extending the legal drama until later in September, as Law & Crime reports.

Acting New York Supreme Court Justice Juan Merchan is at the center of Donald Trump’s high-profile hush-money case.

Recently, Trump’s legal team has intensified efforts to have Merchan recuse himself, arguing a conflict of interest due to the professional relationship between Merchan’s daughter and Vice President Kamala Harris.

Ruling On Recusal Motion Expected Soon

The renewed recusal motion is part of a broader defense strategy by Trump's attorneys, who contend that Loren Merchan, the judge's daughter, maintains a "beneficial working relationship" with Harris.

This connection, they claim, could influence the impartiality of the case. A decision on the recusal is now slated for the week of August 11, adding another layer of anticipation to the proceedings.

Meanwhile, the sentencing for Trump, set for Sept. 18, looms. Merchan has also acknowledged Trump's motion to set aside his 34 guilty verdicts related to falsifying business records.

This decision on that request has been rescheduled from Sept. 6 to Sept. 16, just days before the sentencing.

Previous Attempts at Recusal Unsuccessful

An ethics panel previously ruled in May 2023 that Judge Merchan's impartiality could not be questioned due to his daughter's activities. Further, in August 2023, Merchan issued a ruling that he would not recuse himself from the case, despite the defense's claims. Trump's attorneys have repeatedly cited the judge’s daughter's political work as a basis for their recusal arguments.

Merchan also expanded a gag order against Trump in April, aimed at preventing public statements about the families of court staff or related personnel, which includes his daughter. This expansion underscores the contentious nature of the proceedings and the tensions surrounding the case.

The defense recently argued that Loren Merchan’s role with Harris is particularly relevant now that Harris has announced her candidacy for president.

They claim that Loren benefits substantially from her relationship with Harris, which they allege affects the case's impartiality.

DA Bragg Dismisses Recusal Bid as Vexatious

Manhattan District Attorney Alvin Bragg has responded to these claims by dismissing the latest recusal bid as vexatious and unsupported by new facts or legal changes. In his statements, Bragg emphasized that the defense had not identified any new facts or changes in the law that would warrant a different outcome from previous motions, which had already been denied.

Trump’s attorneys have stated, "Your Honor’s daughter has a long-standing relationship with Harris, including work for political campaigns. She has obtained -- and stands to obtain in the future -- extensive financial, professional, and personal benefits from her relationship with Harris." This statement is part of their continued push to highlight what they perceive as a conflict of interest.

They also noted Loren Merchan's previous public criticisms of Trump's use of Twitter, which they argue shows a prejudgment of the case.

"Your Honor’s daughter was publicly critical of President Trump’s use of Twitter—a central issue in the pending Presidential immunity motion—and described a discussion on that topic with Your Honor that evidences prejudgment of President Trump’s official-acts arguments," said Trump’s attorneys.
