Judge Permits Don Lemon's Lawsuit Against X to Proceed
In a pivotal legal decision, a San Francisco court has ruled that former CNN personality Don Lemon can continue his lawsuit against Elon Musk and the social media platform X, as Breitbart reports.
The lawsuit at issue stems from the sudden cancellation of Lemon’s content deal with X, initiated after an intense interview with Musk that was meant to promote his new show on the platform.
Initial agreement's breakdown explained
Lemon, previously a key figure at CNN, finalized a partnership with X in December 2023. The agreement promised Lemon $1.5 million, a considerable share of ad revenue, and bonuses linked to performance.
The journalist was also required to attend the Consumer Electronics Show in January as part of the deal's announcement requirements. However, the arrangement swiftly encountered significant hurdles.
Musk terminated the partnership with a simple text, "contract is canceled," and X’s Brett Weitz later clarified that all prior promises were null due to the lack of a signed agreement.

The case was brought before Judge Harold Kahn, who has allowed Lemon to proceed with claims including fraud, misappropriation of name and likeness, breach of implied contract, and unjust enrichment.
While certain claims were dismissed by the judge, including negligent misrepresentation and defamation, Judge Kahn provided Lemon the chance to amend his breach of express contract claim, seeking clarity on the agreement’s nature -- whether it was oral, written, or implied.

Lemon’s legal representative, Carney Shegerian, commented on the ruling, highlighting its significance.
“The ruling means Don can hold X and Musk accountable in open court. Musk is subject to the legal process, just like everyone else, and that’s important," Shegerian said.
Shegerian vehemently highlighted the documented evidence against Musk, reinforcing the legal challenge ahead.
“There’s no question about Musk’s motives and liability, as documented in his own texts and on X for millions to see," the lawyer added.
In contrast, Brett Weitz of X succinctly stated the company's stance.
Weitz claims that the absence of a signed agreement nullifies any obligation to honor previous commitments to Lemon.
