Justice Department reportedly set to charge Monical McIver in wake of ICE protest

 May 18, 2025

The Justice Department is said to be preparing charges against Rep. LaMonica McIver (D-NJ) following an altercation with immigration officials at Delaney Hall.

During a monitoring visit to a detention facility, McIver and other officials found themselves in a confrontation with federal agents, leading to what appear to be imminent charges against the congresswoman, as the New Jersey Globe reports.

On May 9, McIver, along with fellow New Jersey Democrats Newark Mayor Ras Baraka, Rep. Bonnie Watson Coleman, and Rep. Rob Menendez, visited the Delaney Hall detention center in Newark. The purpose of their visit was oversight, as the facility had recently begun housing immigrant detainees.

During the visit, federal authorities detained Baraka, claiming he was trespassing on public property. However, Baraka contended that he was merely following federal instructions.

This arrest led to a physical altercation involving the representatives, Immigration and Customs Enforcement (ICE) agents, and bystanders.

Tensions rise at ICE facility

Amid conflicting narratives, allegations emerged against McIver regarding her actions during the scuffle. Accusations suggest she attempted to protect Baraka, with some claims suggesting physical engagement with ICE officers. Contradictory accounts and video evidence have made it difficult to determine the exact nature of McIver's actions.

Officials are homing in on McIver as the primary target for charges, largely due to her visibility in the available video footage. On the other hand, Menendez and Watson Coleman are less prominently featured in the recordings.

As the situation escalated, Republicans in the U.S. House began to consider formal action against the involved representatives. Possibilities include censure or the removal of committee assignments, although specific decisions have not yet been forthcoming.

Statements, denials follow incident

Amidst these developments, Speaker of the House Mike Johnson acknowledged potential disciplinary measures. Uncertainty persists around which consequences might be enacted, but the gravity of the allegations has maintained political pressure.

In response to these allegations, McIver and others have robustly denied any wrongdoing. Supporting these denials, a spokesperson for Watson Coleman remarked on body cam footage showing federal agents physically connecting with the representatives.

They refuted claims of violence against officers, asserting that "Nobody was ‘body slammed,’ nobody ‘assaulted’ any agents.”

Further muddying the waters, the Justice Department is thoroughly reviewing available evidence, including video recordings, to understand the full scope of events.

While video footage is said to be inconclusive, verbal accounts differ widely regarding who initiated the scuffle.

Legal representation retained

For her defense, McIver has retained legal counsel in Paul Fishman and Lee Cortes. Their strategy moving forward will likely center on discrediting claims of violence and showcasing discrepancies in the federal narrative.

Within the deeply polarized atmosphere, this incident has ignited heated political discussions. Both parties await the judicial review’s outcome to further their respective arguments.

As the investigation progresses, questions loom over the potential legal implications and future of the implicated parties. In the meantime, as pronouncements from the Justice Department develop, all eyes remain on the judiciary’s eventual determination.

Despite the controversy, supporters of McIver assert that her actions were justified in the context of safeguarding colleagues and associates. They emphasize the importance of oversight in detention centers and argue the significance of holding agencies accountable.

The outcome of these legal proceedings will likely have significant ramifications for both the political landscape and models of oversight operative at detention centers nationwide. As tensions persist, the balance between elected officials' roles and federal authority continues to be intensely scrutinized in legal and public forums.
