Trump Legal Team Challenges DA Fani Willis In Georgia Appeals Court

In a significant legal move, former President Donald Trump’s attorneys submitted a reply brief to the Georgia Court of Appeals, targeting the disqualification of Fulton County District Attorney Fani Willis. Willis has been actively prosecuting Trump and his co-defendants over allegations of attempting to overturn the 2020 presidential election results in Georgia, Fox News reported.

The brief contends that Willis's conduct and past statements warrant her removal from the case, setting a crucial hearing for December 5.

The appeal follows a contentious phase of legal skirmishes between Trump’s legal team and DA Willis. In June, Willis moved to dismiss the appeal, which Trump’s team initiated after a March ruling by Fulton Superior Court Judge Scott McAfee permitted Willis to remain on the case. Trump, along with 18 co-defendants, faces multiple charges, including violations of the Georgia RICO Act and conspiracy charges connected to the election.

Allegations of Misconduct Surface

Challenges to Willis's role in the prosecution surfaced after various allegations of misconduct. Judge McAfee criticized the vagueness of the indictment in March, leading to the dismissal of six charges. Additionally, allegations accused Willis of having an “improper” affair with Nathan Wade, a former special prosecutor hired for the case.

Both Wade and Willis denied any romantic involvement prior to his hiring, but the scrutiny intensified, leading McAfee to remove Wade from the case after an evidentiary hearing in February.

Another point of contention arose when Willis spoke at an Atlanta church in January, where she was accused of using racially charged rhetoric. Judge McAfee deemed the speech legally improper, further complicating her position in prosecuting the case.

Trump's Legal Team Cites Professional Misconduct

According to Trump’s attorney, Steve Sadow, the recent filings strongly counter the state’s arguments for keeping Willis on the case. “President Trump’s legal team has filed a reply brief in the Georgia Court of Appeals persuasively rebutting the State’s arguments,” stated Sadow.

The brief argued that Willis's conduct, particularly her speech in church, aimed to incite public condemnation and prejudice against Trump and his co-defendants. It described her actions as a calculated move that violates the Georgia Rules of Professional Conduct, necessitating her disqualification and the case’s dismissal.

Moreover, the legal documents highlighted an appearance of impropriety that casts doubt on the integrity of the prosecution team. Judge McAfee, in his earlier ruling, noted that this appearance of impropriety "infects the current structure of the prosecution team – an appearance that must be removed through the State’s selection of one of two options."
