The controversy centers around two new laws that Gov. Newsom signed, which extend existing regulations to include AI-generated "deepfake" content on social media platforms. These laws mandate that platforms label or remove content they determine to be deceptive. California maintains a proactive stance on digital content and election integrity, expanding on previous legislation related to campaign communications with these new laws.

Federal Lawsuit Filed Against California's New Laws

A conservative social media user, known by the handle @MrReaganUSA, initiated a lawsuit in the U.S. District Court for the Eastern District of California. The challenge argues that the laws infringe upon free speech rights and impose excessive burdens on content creators.

@MrReaganUSA gained attention after creating an AI-generated parody of a Kamala Harris campaign advertisement, which spread widely after the laws were enacted. This instance highlights the contentious nature of defining what constitutes deceptive or manipulative content online.

The legislation specifically targets deepfake content, defining it as digitally altered media that could deceive viewers. However, it exempts satire and parody, provided they are clearly labeled to prevent any potential misinformation.

The new laws require social media platforms to establish mechanisms addressing complaints about content within 36 hours, aiming to swiftly curb the spread of potentially misleading videos. Additionally, the legislation allows civil penalties and judicial intervention if individuals create or distribute deceptive deepfakes 60 days before or after an election.
