North Carolina Democratic Chair Fears State Court May Upset Election Results

 December 13, 2024

Tensions are rising in North Carolina as the state's Supreme Court race intensifies. Two recounts have confirmed Democratic Justice Allison Riggs's lead over Republican challenger Jefferson Griffin. Challenges to the validity of thousands of ballots and legislative maneuvers aiming to alter the balance of state power have marked this highly contested race.

North Carolina Democratic Party Chair, Anderson Clayton, has voiced significant concerns regarding the potential for the state Supreme Court to overturn the election results. This follows two recounts which both showed Justice Riggs maintaining a narrow lead. Initially, Riggs was ahead of Griffin by 734 votes, The Hill reported.

The controversy deepened with a second recount, partially conducted by hand, which concluded this Tuesday. Despite adding more votes to Riggs' tally than Griffin's, the Republican side has raised issues over 60,000 ballots, challenging their validity and demanding further scrutiny.

GOP's Legislative Strategies Raise Concerns

The political landscape is further complicated by recent legislative actions. Democratic Governor Roy Cooper vetoed a bill that proposed shifting powers from predominantly Democratic-held offices to Republican-controlled positions, including the state auditor and legislature. This bill, affecting key roles such as the governor, attorney general, and state superintendent, highlights a significant shift in governance.

This legislative move comes in the backdrop of Democrats gaining a seat in the state House, effectively breaking the GOP’s veto-proof supermajority. However, the state Senate managed to pass a veto override along party lines, with the state House yet to vote. Initially, three Republicans opposed the bill.

Anderson Clayton has pointed to these legislative efforts as indicative of potential power manipulation. This scenario complicates the electoral process, intertwining it with broader governance issues that could influence the outcome.

Election Integrity at the Heart of the Dispute

A lawsuit aimed at preserving the votes of the 60,000 challenged voters is currently underway. It alleges problems with voter registration forms, highlighting the stakes involved in ensuring every vote is counted accurately. Meanwhile, the state elections board opted against a full hand recount after evaluating the results of the second recount.

Clayton's remarks underscore the gravity of the situation. "Do I have fear? Absolutely," he stated, expressing his commitment to defending voter rights and democratic integrity against what he views as unconstitutional power use by some branches of government. His concerns reflect deep-seated issues with the state's current political dynamics.

"Are you seriously thinking that they would not be this manipulative and this malicious with the people and the power that they hold in this state?" Clayton further questioned, highlighting the distrust and tension surrounding the election proceedings.

Mobilizing Public Support and Legal Avenues

In response to the ongoing challenges, Clayton emphasizes the importance of public engagement and legal action. "At this moment in time, we are trying to make sure that people are raising their voices, that we are filing lawsuits where we can to hold back, and we are also trusting the process of our board of elections officials to do their job and to count every single vote and to recount every single vote," he stated, detailing the multi-faceted approach being taken to protect the integrity of the election.

The situation remains fluid, with both legal and political battles shaping the final outcome. As lawsuits progress and legislative debates continue, the ultimate resolution of North Carolina's Supreme Court race hangs in balance, reflecting broader national issues of electoral integrity and political power struggles.
