Pennsylvania High Court Blocks Philadelphia's Gun Control Initiatives

In a landmark decision, the Pennsylvania Supreme Court has unanimously overruled Philadelphia's ambitious gun control measures.

The Pennsylvania justices reaffirmed state-level authority, denying the city's bid to implement stricter gun laws, as Breitbart reports.

The legal tussle began in 2020 when Philadelphia, led by then-Mayor Jim Kinney, filed a lawsuit challenging the state's preemption laws that restrict local governments from enforcing gun control measures surpassing state regulations.

On Oct. 7, 2020, Mayor Kinney held a press conference in Germantown to announce this legal challenge.

Philadelphia's Legal Battle Against State Gun Laws

The Kinney administration argued that the state's preemption laws hinder effective gun safety strategies that could be beneficial, particularly in low-income areas and large urban centers like Philadelphia.

Officials sought an exemption that would allow the city to enforce regulations such as mandatory permits for gun purchases and limits on the number of firearms one could buy within a certain timeframe.

However, on Nov. 20, 2024, the Pennsylvania Supreme Court delivered a 6-0 verdict against the city's proposal. The court held that the city's arguments did not meet the legal standards required to overturn the preemption law.

Supreme Court Upholds State's Preemption Law

In its ruling, the court emphasized the tragic nature of gun violence but stated the resolution of such issues lies with the state legislature, not the judiciary.

The majority opinion pointed out that while local sentiments might support stricter regulations, the state's preemption laws are legally binding and must be respected.

"The accounts of gun violence set forth in the Petition, like all other instances of gun violence, are undeniably tragic," read the majority opinion from the Pennsylvania Supreme Court. "Such questions are solely for the legislature to determine and upon their province, we must not encroach."

Preemption laws are common across many states in the U.S. and serve to create uniform state-level regulations that prevent municipalities from enacting their own disparate gun control laws.
