Robert F. Kennedy Jr. to Stay on Ballots in Key States Despite Campaign Suspension

 August 30, 2024

Robert F. Kennedy Jr. has suspended his independent presidential campaign and endorsed former President Donald Trump.

Despite his decision to effectively exit the race, because of various legal and procedural challenges, Kennedy's name will continue to appear on ballots in Wisconsin, Michigan, North Carolina, and Minnesota, as USA Today reports, something many believe is evidence of Harris campaign concerns about the current state of the election.

Kennedy initially sought to withdraw his candidacy in about ten battleground states. His goal was to prevent himself from becoming a "spoiler" by diverting votes to Harris that might otherwise go to Trump. However, his efforts to remove his name from the ballots have hit several legal snags.

Kennedy’s Name Stays on Ballots in Key States

In Wisconsin and Michigan, Kennedy’s name will remain on the ballot as confirmed by the Wisconsin Elections Commission and the Michigan Secretary of State's office.

These states have firm regulations that make it nearly impossible for a candidate to be removed from the ballot once they have qualified. Wisconsin law, for instance, stipulates that a candidate "cannot decline nomination... except in case of death."

In North Carolina, the situation is even more complicated. Absentee ballots with Kennedy’s name have already been printed and are set to be mailed to voters beginning Sept. 6.

The North Carolina State Board of Elections has not received any notification from the We The People Party, which Kennedy was affiliated with, to remove his name. This delay means that his name will remain on the ballot for the upcoming election.

Legal Hurdles and State-Specific Rules

Kennedy's attempt to withdraw from the race has been thwarted by state-specific legal requirements. For example, in Minnesota, the Secretary of State’s office has confirmed that Kennedy’s name will appear on the ballot. Similar to Wisconsin, Minnesota's laws provide little room for a candidate to withdraw once their name has been submitted and approved.

While Kennedy’s name will remain on the ballot in some states, he has managed to successfully withdraw in others. His name will not appear on ballots in Pennsylvania, Georgia, Nevada, and Arizona.

In these states, he either withdrew before the deadline or was not approved for the ballot in the first place. For example, a judge in Georgia ruled that Kennedy did not qualify for the state’s ballot due to questions surrounding his residency.

Complexity in Other States

In addition to the states where his name will remain on the ballot, Kennedy’s efforts to withdraw have also been successful in several other places. He will not appear on the ballots in Ohio, Texas, and Florida, where he successfully withdrew his candidacy in time to avoid printing.

These states allowed him to remove his name before their respective deadlines, providing a clearer path for voters who may have been considering him.

However, not all states have been as straightforward. In New York, a judge blocked Kennedy from appearing on the ballot due to a discrepancy regarding his listed residence. The decision echoed the ruling in Georgia, where similar issues around residency were raised.

Impact on the Election Landscape

Kennedy’s decision to suspend his campaign and endorse Trump while remaining on several key state ballots adds a layer of complexity to the election. His continued presence on the ballots in battleground states such as Wisconsin, Michigan, and North Carolina could affect the vote count, potentially splitting the vote in ways that could influence the outcome.

Kennedy has stated that he intends to remain on the ballot in states that are not closely contested. This strategy would allow his supporters to vote for him without affecting the overall balance of the election. However, in tightly contested battleground states, his continued presence could lead to unforeseen consequences, including the possibility of splitting the vote in favor of another candidate.

Conclusion

As the November election approaches, the presence of Robert F. Kennedy Jr.'s name on ballots in key battleground states remains a significant point of discussion. His suspension of the campaign and subsequent endorsement of Trump adds further intrigue to an already unpredictable election season. With ballots already printed and legal restrictions preventing his removal, Kennedy’s impact on the race remains an open question.

Kennedy’s situation illustrates the complexities of election laws and the challenges candidates face when attempting to navigate them. While he has succeeded in removing his name from some ballots, the hurdles in states like Wisconsin, Michigan, and North Carolina serve as a reminder of the intricacies involved in electoral processes.

Ultimately, Kennedy’s continued presence on these ballots may play a pivotal role in shaping the final outcome of the election, leaving both voters and political analysts to ponder the potential implications.
