Rubio sanctions ICC judges over probes targeting US, Israel

The Trump administration recently imposed sanctions against four judges from the International Criminal Court (ICC), accusing the body of conducting politically motivated investigations targeting the United States and Israel. The ICC condemned these actions, defending its commitment to maintaining international justice and following international law.

The sanctions were announced by Trump administration Secretary of State Marco Rubio, targeting ICC judges Solomy Balungi Bossa, Luz del Carmen Ibáñez Carranza, Reine Adelaide Sophie Alapini Gansou, and Beti Hohler, as the Daily Caller reports.

These judges faced sanctions for their roles in two separate decisions involving the U.S. and Israel. Judges Bossa from Uganda and Ibáñez Carranza of Peru approved an investigation into alleged war crimes committed by U.S. troops in Afghanistan. Meanwhile, their counterparts, Gansou from Benin and Hohler from Slovenia, issued arrest warrants for Israeli officials.

Charges against Israeli officials spark reactions

The warrant against Israeli Prime Minister Benjamin Netanyahu and Defense Minister Yoav Gallant was issued over allegations of war crimes in Gaza in November 2024.

Rubio criticized the ICC judges for their supposed misuse of authority, describing their actions as politically motivated abuses of power.

The secretary of State expressed that these decisions by the ICC judges infringed upon the sovereignty and safety of both the United States and its ally, Israel.

He reaffirmed the U.S. commitment to defending its interests and those of its allies from what he termed as illegitimate actions brought by the ICC.

The ICC quickly countered the sanctions, suggesting they were part of an effort to weaken the independence of an international judicial body. The court emphasized its dedication to proceeding with its mandate and standing by its personnel.

International reactions emerge

The United Nations human rights chief, Volker Türk, expressed his concerns regarding the sanctions, arguing that they undermine respect for the rule of law. He urged a reconsideration and withdrawal of these measures, highlighting U.S. values historically aligned with equal protection and adherence to legal standards.

Reflecting on U.S. domestic reactions, a majority of House Democrats repudiated previous attempts to sanction the ICC for its decisions against Israel's leadership.

Former President Joe Biden did, however, voice his disapproval of the ICC's judgments against Israeli leaders, denouncing them as excessive.

Biden also reiterated that there was no comparison between the actions of Israel and those of Hamas. He assured unwavering U.S. support for Israel against any threats to its security.

Mixed perspectives on ICC's role

Despite the vocal opposition from some corners, Rubio insisted that the ICC's accusations against the U.S. and its allies impinge upon national security interests. He vowed that the U.S. would take necessary measures to protect its sovereignty.

While the ICC continued its work in line with the Rome Statute, it emphasized what it said was the importance of fairness, due process, and justice for victims of severe international crimes.

Amid criticism, particularly towards Türk’s inconsistent record on human rights violations across various countries, some have called for balanced scrutiny. They noted criticism of countries like the U.S. and contrasted with limited remarks on contentious practices in nations such as China and North Korea.

The unfolding of these events has led to further discussions about the role and independence of international judicial bodies like the ICC. The dispute underscores tensions between national sovereignty and international accountability.

While attempts to gain comments from both the State Department and the ICC were unsuccessful, the debate over international justice mechanisms and state sovereignty continues to captivate global attention.
