State Sen. Jenifer Branning Elected to Mississippi Supreme Court

 December 9, 2024

A state lawmaker has emerged victorious in the Mississippi Supreme Court's recent runoff, unseating an incumbent candidate.

On Nov. 26, state Sen. Jenifer Branning won a pivotal runoff election against Justice Jim Kitchens for a seat on Mississippi's high court, as the Associated Press reports.

The initial vote on Nov. 5 saw neither candidate secure a majority, leading to the subsequent runoff.

Branning and Kitchens had been the top contenders in a crowded field, necessitating a decisive second round of voting to determine the winner.

This judicial contest was held in District 1, which spans a diverse area from the Delta region through the Jackson metropolitan to the Alabama border.

Diverse Support Across Political Lines

While judicial races in Mississippi do not disclose party affiliations on the ballot, political undercurrents play a significant role.

Geographic regions known for Democratic Party leanings threw their support behind Kitchens, whereas Branning received strong backing from areas with Republican majorities.

Endorsed by the state Republican Party, Branning has been vocal about her conservative stance. She champions what she terms a "constitutional conservative" approach, aiming to resist the influence of what she describes as "liberal, activist judges."

Branning's Political and Judicial Philosophy

Throughout her campaign, Branning emphasized her commitment to a conservative interpretation of the law, opposing the perceived encroachment of progressive judicial perspectives.

On the other side, Justice Kitchens, seeking a third term and poised to become the next chief justice, focused on his extensive judicial experience.

He highlighted his role in major decisions, such as a recent case involving a death row inmate where he sided with reconsidering the conviction.

Notable Endorsements and Judicial Records

Kitchens has also been notable for his stances on contentious issues like the use of the drug midazolam in executions, where he expressed dissent in 2018.

His judicial philosophy earned him the endorsement of the Southern Poverty Law Center’s Action Fund.

The official results announced by The Associated Press on Friday confirmed Branning's win, marking a significant shift in the makeup of the Mississippi Supreme Court.

Transition of Roles and Future Aspirations

Reacting to the election outcome, Kitchens expressed gratitude for his years of service on the court. "During the 16 years that I was privileged to serve the people of Mississippi on their highest court, I have kept my oath of office by administering justice without respect to persons and by doing equal right to the poor and the rich," he stated.

He also announced his intention to return to the practice of law, aiming to continue his advocacy for justice in a new capacity.

Reflections on the Campaign and Its Implications

The election results not only reflect the regional political dynamics but also indicate a potential shift in judicial philosophy for the state's highest court.

As Branning prepares to take her place on the bench, Mississippians watch closely to see how her promised conservative judicial approach will influence forthcoming legal debates and decisions.
