Stefanik Files Ethics Complaint Over Merchan's Connection to Harris Campaign

Rep. Elise Stefanik (R-NY) has filed an ethics complaint against New York Supreme Court Justice Juan Merchan, alleging a potentially disqualifying conflict of interest.

Stefanik charges that Justice Merchan’s impartiality is compromised due to his daughter's company's financial relationship with Harris’s campaign, doing so even as Merchan postponed President Trump’s sentencing, as Fox News reports.

The lawmaker's complaint, lodged with the New York State Commission on Judicial Conduct, came on the same day Justice Merchan decided to delay Trump’s sentencing in the case of New York v. Trump. The case resulted in Trump's conviction on 34 counts of falsifying business records, following a six-week trial overseen by Manhattan District Attorney Alvin Bragg.

Harris Campaign's Link to Merchan's Daughter

At the center of Stefanik's complaint is a Federal Election Commission report showing a transaction between Harris’s campaign and Authentic Campaigns Inc., a company led by Loren Merchan, Justice Merchan’s daughter. Authentic Campaigns Inc. provided web hosting services to Harris’s campaign after she secured the Democratic nomination.

Stefanik alleges that the hiring of Loren Merchan's company poses an ethical conflict for Justice Merchan, especially given his role in the ongoing legal proceedings involving former President Donald Trump. "This indicates that one of the very first things that Harris did upon taking over the Biden campaign infrastructure is to hire this firm, Authentic," Stefanik said, referring to the timing of the contract.

Stefanik Raises Concerns About Ethical Violations

In her complaint, Stefanik asserts that Justice Merchan’s relationship with his daughter violates judicial ethics, which require judges to recuse themselves if a relative has a financial interest in the case's outcome. Stefanik argues that Merchan's involvement in Trump's trial, combined with his daughter’s company’s financial ties to Harris, presents an unacceptable conflict.

"Ms. Merchan is related to Justice Merchan in the first degree. Authentic has a newly active financial relationship with Vice President Harris’s campaign," Stefanik stated, emphasizing the importance of judicial neutrality in the case.

Stefanik's filing also suggests that the financial arrangement could be part of a broader relationship with long-term benefits for both Harris’s campaign and Loren Merchan's company. "This is merely the beginning of a new contract with a new campaign, regardless of the amount reimbursed. Sure, there’s an immediate benefit, but this is a play at a potential larger benefit for Authentic and Merchan down the road," she added.
