The legitimacy of the USCIS’s action was upheld by the Board of Immigration Appeals and subsequently by the Eleventh Circuit Court. The Supreme Court reinforced this decision, agreeing that it lacked jurisdiction over such discretionary agency decisions.

Justice Ketanji Brown Jackson underscored the discretion granted to the secretary of Homeland Security to revoke visas at any point for what is considered "good and sufficient cause."

Authority to Revoke Visas Affirmed

The unanimous decision by the Supreme Court stresses the discretionary power under Section 1155 of the Immigration and Nationality Act. This section allows the Secretary of Homeland Security the authority to revoke a previously approved visa petition "at any time" if they deem there is "good and sufficient cause."

Moreover, in June, the Supreme Court ruled favorably in three consolidated deportation cases involving illegal foreign nationals from El Salvador, India, and Mexico who did not appear at their hearings.

The Court upheld their ordered removals, dismissing the plaintiffs’ arguments that they had not received proper notification and that there were technical errors in the orders.
